Legal Guarantee of Conformity and Product Returns

1. Legal guarantee

Goods sold by JIVA BOUTIQUE SRL through ManHair benefit from the legal guarantee under Romanian Emergency Ordinance no. 140/2021, approved with amendments by Law no. 205/2023, and other applicable rules.

The Seller is liable for non-conformity existing at delivery and identified within the statutory two-year period. The legal guarantee is separate from an additional commercial guarantee.

ManHair provides no additional commercial durability guarantee unless expressly stated for a particular product.

2. Possible non-conformity

A product may be non-conforming if it does not match the agreed description, type, quantity or quality, is not fit for ordinary use, or lacks accessories and instructions reasonably expected.

Minor shade differences caused by screens, lighting or production batches, and final appearance influenced by head shape, fitting and personalisation, are not automatically non-conformities.

3. What is not a manufacturing defect

• normal wear of hair, base, edges, tapes and friction areas;
• thinning, tangling or dryness caused by wearing, sleeping, perspiration, friction or care;
• damage caused by heat, dyeing, bleaching, cutting, styling, chemicals or incompatible products;
• base tearing or hair loss caused by incorrect handling, combing or fitting;
• damage caused by failure to follow washing, drying, storage, application or removal instructions;
• individual scalp reactions or incompatibility with an adhesive or solvent;
• shorter bonding time caused by sebum, perspiration, temperature, activity, skin preparation or maintenance.

The useful life of a hair system and adhesive hold time vary with the product, wear frequency, lifestyle, maintenance and individual characteristics. Estimates are not commercial durability guarantees.

4. Customised products and services

Cutting, colouring, ventilation, base adjustment, adhesive application and other requested changes do not remove rights relating to a defect existing at delivery, but damage resulting from modification or later use is not a manufacturing defect.

Consultation, fitting and maintenance services are distinct from the legal guarantee for goods. Results and bonding duration can depend on individual factors and compliance with instructions.

5. Remedies

Under applicable law, the Consumer may be entitled to repair or replacement without cost and significant inconvenience. Where legal conditions are met, a proportionate price reduction or termination may be requested.

6. Reporting a problem

Send the order number or proof of purchase, problem description, date identified, clear photographs and information about use and care to office@jiva.ro. The product may need to be presented for assessment.

After identifying a problem, do not continue using, cutting, colouring, gluing or modifying the product if this could worsen damage or prevent assessment.

7. Returns

The withdrawal right for online orders is separate from the legal guarantee. Consumers have a statutory 14-day withdrawal right, subject to legal exceptions. ManHair also offers a commercial return of up to 30 days for eligible, unused products meeting the Return Policy.

Customised products and sealed goods unsuitable for return for genuine health or hygiene reasons may be exempt if unsealed after delivery. Hair systems and wigs are not automatically excluded solely because of their product name.
